In her recent news letter Dawn Cross of Face2FaceHr highlighted the importance of having clear policies and procedures in place after a recent case in the Channel Islands.
A chef was hand a custodial sentence after he had violently attacked a police office. Six months later, the chef discovered that he had been dismissed from his from his job, and after bringing a claim, was awarded compensation of £11,000.
The Guernsey Employment and Discrimination Tribunal, who heard the case, agreed that the behavior of the chef was sufficient to warrant dismissal, but felt that as the employer had failed to follow any kind of process compensation was justified. It found that there had been no investigation, no discussion with witnesses, and no right of appeal given.
